SOLiD Gear, Inc. (“SOLiD”, “we”, “us”, and “our”) respects the privacy rights of our customers, vendors and business partners and are committed to protecting your privacy. This Privacy Policy (the “Policy”) explains our data handling practices as a “Controller” with regard to your Personal Data, as well as your rights associated with your Personal Data. This Policy was last materially updated on June 1, 2018.  “You” and variations (e.g., “your”) shall refer to the person accessing the SOLiD Gear, Inc. website (solid.com) for any reason, including the completion of a “contact” form or any other method of communicating with SOLiD.

A. Scope

SOLID Gear, Inc. (“SOLiD”) is a data controller for purposes of this Policy. This Policy covers the information we collect about you in connection with our business, which does, or can be used to identify you as an individual (“Personal Data”). It does not apply to information that cannot reasonably identify you as an individual. For example, but without limitation, aggregated anonymous data, computer operating systems, aggregated preferences, vehicle identification numbers, etc. are not Personal Data.
Our website (dev.solid.com) is not directed to individuals under the age of 13, and we do not knowingly obtain Personal Data from such individuals.
Our website is linked to the website of our parent company, SOLiD, Inc., which is a South Korean company (“SOLiD Korea”) headquartered in South Korea, and is used as the English language version of SOLiD Korea’s website www.solid.co.kr).  This Privacy Policy applies to any visitor to the SOLiD website that arrives there by linking through the SOLID Korea website.

B. Data Collections Specifics

We collect Personal Data that you may provide on our website and offline in connection with any inquiries, tradeshows or industry conferences. Information collected about your use of our website may be combined with personal or other information about you from other online or offline sources. We also will collect Personal Data across all the devices you use to access our website.
Providing your Personal Data to us may be required due to a legal obligation which could be a statutory or contractual obligation, may be on a voluntary basis or may be necessary for us to enter into a contract with you, depending on the purposes for which we collect and use your Personal Data as set out in this Privacy Policy. However, unless otherwise stated, not providing your Personal Data will not result in legal consequence for you.
Do not provide information about others unless you are authorized to do so and have obtained consent to have all information used, disclosed, and transferred in accordance with this Privacy Policy. We will not charge you for such calls or texts.

We may use your Personal Data to provide you with marketing information, special offers, and promotions via various means including e-mail, in accordance with applicable law. Where we have obtained your consent to send these marketing communications to you, we therefore process your Personal Data for these purposes on the basis of your consent. However, where permitted by applicable law we may lawfully use your Personal Data to send you such marketing communications (including via email) without your consent. Where permitted by applicable law we may also process your Personal Data for these marketing purposes where necessary for our legitimate interests, which include promoting our products and services, special offers and promotions which may be of interest to you.

3. NORMAL COURSE OF BUSINESS:
We may process your Personal Data and other information if such processing is necessary: (a) to comply with the law or in response to a subpoena, court order, law enforcement request, or other legal process; (b) to protect our interests, rights, safety, or property or those of others; (c) to enforce any terms of service on our websites; (d) to provide you and others with the services or products requested by you or your designated representative, and to perform other activities related to such services and products, including billing and collection; (e) to provide you with special offers or promotions that may be of interest to you, where permitted; (f) as part of a business transaction where you purchase, lease or otherwise acquire any products or services from us or are otherwise transferred by act of law or contract; or (g) to operate our systems properly.
4. RECRUITMENT FOR EMPLOYEES AND CONTRACTORS:
We may collect and process your Personal Data and other information as an essential part of the hiring and contracting processes for individuals desiring to work with or for SOLiD and/or SOLiD Korea. For example, if you apply for a position or an independent contractual relationship with SOLiD or SOLiD Korea then your Personal Data may be used to contact your for follow up meetings or information, to judge your suitability for any open positions or relationships, and to cooperate with government authorities related to labor, hiring, immigration, discrimination and other rules and regulations.

D. Disclosures to Third Parties:

1. THIRD-PARTY PROVIDERS:
For the purposes described in this Privacy Policy, we may share your Personal Data and other information with our service providers and business partners (“Third-Party Provider”), such as health and benefits companies and our parent company, SOLiD Korea. We may share with other third parties aggregate or anonymized information about our website users, such as your use of this website or other websites, and the services provided on this website or other websites. You may instruct us at any time not to share your Personal Data covered by this Privacy Policy with such Third-Party Providers by contacting us in the manner set forth below. Please note that (i) this opt-out process may take some time to complete, consistent with applicable law; and (ii) even after such opt-out process is completed, your Personal Data and other information will continue to be shared with SOLiD Korea and designated service providers.

2. SOCIAL MEDIA:
SOLiD encourages employees to share information with coworkers and with those outside the Company for the purposes of gathering information, generating new ideas, and learning from the work of others. Social media provides inexpensive, informal, and timely ways to participate in an exchange of ideas and information. However, information posted on a website is available to the public, and therefore, the Company has established the following guidelines for employee participation in social media.

Note: As used in this policy, “social media” refers to blogs, forums, and social networking sites, such as Twitter, Facebook, LinkedIn, YouTube, Instagram, and Snapchat, among others.

Off-duty Use of Social Media. Employees may maintain personal websites or weblogs on their own time using their own facilities. Employees must ensure that social media activity does not interfere with their work. In general, the Company considers social media activities to be personal endeavors, and employees may use them to express their thoughts or promote their ideas.  In addition, employees may not post on a personal blog or webpage or participate on a social networking platform for personal purposes during work time or at any time with Company equipment or property.

On-duty Use of Social Media. Employees may engage in social media activity during work time provided it is directly related to their work and approved by their manager and does not identify or reference Company clients, customers, or vendors without express permission. The Company monitors employee use of Company computers and the Internet, including employee blogging and social networking activity.

Respect. Demonstrate respect for the dignity of the Company, its owners, its customers, its vendors, and its employees. A social media site is a public place, and employees should avoid inappropriate comments. For example, employees shall not divulge SOLiD’s confidential information such as trade secrets, client lists, or information restricted from disclosure by law on social media sites.  Similarly, employees should not engage in harassing or discriminatory behavior that targets other employees or individuals because of their protected class status or make defamatory comments or engage in other behavior that violates the Company’s policies.

Post Disclaimers. Employees who identify themselves as Company employees or discuss matters related to the Company on a social media site must include a disclaimer on the front page stating that the views expressed by the employees do not constitute the views of the Company and that the employees are expressing only personal views—for example: “The views expressed on this website/blog are mine alone and do not necessarily reflect the views of my employer.” Place the disclaimer in a prominent position and repeat it for each posting expressing an opinion related to the Company or the Company’s business. Employees must keep in mind that if they post information on a social media site that is in violation of Company policy and/or federal, state, or local law, the disclaimer will not shield them from disciplinary action.

Competition. Employees should not use social media to criticize the Company’s competition and should not use it to compete with the Company.

Confidentiality. Employees must not identify or reference Company clients, customers, or vendors without express permission. Employees may write about their jobs in general but may not disclose any confidential or proprietary information. For examples of confidential information, employees should refer to the Company’s confidentiality policy and their individual confidentiality agreement(s) with the Company. When in doubt, ask before publishing.

New ideas. Employees should remember that new ideas related to work or the Company’s business belong to the Company. Do not post them on a social media site without the Company’s permission.

Trademarks and Copyrights. Employees should not use the Company’s or others’ trademarks on a social media site or reproduce the Company’s or others’ trademarked, copyrighted, or patented material without first obtaining permission from the owner.

Legal. Employees are expected to comply with all applicable laws, including, but not limited to, Federal Trade Commission (FTC) guidelines and copyright, trademark, and harassment laws.

Discipline. Violations of this policy may result in discipline up to and including immediate termination of employment.

General. Nothing in this policy is meant to, nor should it be interpreted to, in any way limit employees’ rights under any applicable federal, state, or local laws, including rights under the NLRA to engage in protected concerted activities with other employees to improve or discuss terms and conditions of employment, such as wages, working conditions, and benefits. Employees have the right to engage in or refrain from such activities.

3. LINKS TO THIRD PARTIES:
We may provide links to third-party websites or our website may be linked to from third-party websites. Since we do not control third-party sites, and we are not responsible for any information you may provide while on such websites, we encourage you to read the privacy policies on those websites before providing applicable third-parties with your information.

4. GENERAL COURSE OF BUSINESS:

E. Cookies and Online Advertising

We try to strike a balance between the security of your Personal Data and your convenience. Servers which store information are primarily located in the United States and South Korea, although storage may occur in other locations as well
